A. OBJECT OF SCOPE OF APPLICATION
The present General Conditions of contracting and use, have the purpose of regulating the provision of the information supplied in the online store of gatell.com, as well as the commercial transactions that arise between gatell.com and the users of the domain www.gatell.com. Both the navigation through the online store and the acquisition of any of the products offered in it, suppose the acceptance as a user, without reservations of any kind, of each and every one of the present general conditions of contracting and use. Gatell.com will be able to modify the web page to carry out as many changes and modifications as it deems convenient and necessary for the adequate functionality of the same one, without previous notice.
B. INFORMATION PROVIDED ON THE WEBSITE
We make every effort to offer the information contained in the website truthfully and without typographical errors. In the event that at any time there is an error of this type, at all times outside the control of www.gatell.com, we will proceed immediately to correct it. If there is a typographical error in any of the prices shown and a customer has made a purchase decision based on this error, we will communicate this error and the customer will have the right to cancel the purchase without any cost on their part.
Similarly, it is possible that the contents of the website may show, at times, provisional information about some products. In the event that the information provided does not correspond to the characteristics of the product, the customer will have the right to cancel the purchase without any cost on his part. Gatell.com is not responsible either directly or indirectly for any of the information, contents, statements and expressions contained in the products marketed on the website. This responsibility falls at all times on the publishers or distributors of such products. All the contractual information present in www.gatell.com is shown in Spanish language (Castilian), and the communication with the clients and users, as well as the formalization of the contract will be carried out in that language.
C. OBLIGATIONS OF CUSTOMERS AND USERS
In general, the user is obliged to comply with these general conditions, as well as to comply with the special warnings or instructions for use contained therein or on the website and always act in accordance with the law, good customs and the requirements of good faith, using due diligence, and refraining from using the website in any way that may impede, damage or impair the normal operation of the same, the property or rights of gatell.com, its suppliers, other users or in general any third party. It is forbidden the access and use of the portal to minors without the express consent of their parents, gatell.com is not responsible for the veracity and accuracy of the data filled in by the user and therefore cannot verify the age of the same.
Specifically, and without implying any restriction to the previous paragraph, during the use of the website www.gatell.com the user agrees to:
a) Provide truthful information about the data requested in the user registration form or order form, and keep them updated.
b) Not to enter, store or disseminate on or from the website, any information or material that is defamatory, libelous, obscene, threatening, xenophobic, incites violence or discrimination based on race, sex, ideology, religion or that in any way violates morality, public order, fundamental rights, public freedoms, honor, privacy or the image of others and in general the current regulations.
c) Not to introduce, store or disseminate through the store any program, data, virus, code, or any other electronic or physical device that is likely to cause damage to the website, any of the services, or any of the equipment, systems or networks of gatell.com, any other user, the suppliers of gatell.com or any third party in general.
d)Diligently keep the “user name” and “password” with which you register in gatell.com, assuming responsibility for any damages that may arise from improper use of them.
e) Not to carry out advertising or commercial exploitation activities through the website, and not to use its contents and information to send advertising, or send messages for any other commercial purpose, or to collect or store personal data of third parties.
f) Not to use false identities or impersonate the identity of others in the use of the website or in the use of any of its services, including the use of passwords or access codes of third parties or in any other way.
g) Not to destroy, alter, use for use, render useless or damage the data, information, programs or electronic documents of gatell.com, its suppliers or third parties.
h) Not to introduce, store or disseminate through the store any content that infringes intellectual property rights, industrial or business secrets of third parties, or in general any content of which it does not hold, in accordance with the law, the right to make it available to third parties.
The customer undertakes to enable the delivery of the requested order by providing a delivery address where the requested order can be delivered within the usual schedule of delivery of goods. In case of non-compliance by the customer of this obligation gatell.com will have no responsibility for the delay or impossibility of delivery of the order requested by the customer.
D. SHIPPING COSTS
Shipping and/or handling costs are not included in the price and will be shown before finalizing your purchase, depending on the shipping address of each order. Shipping costs to the Canary Islands, Ceuta, Melilla and areas not belonging to the European Customs Union do not include import costs (tariffs), which will be paid in cash at destination by the recipient of the goods.
E. WITHDRAWAL RIGHTS
If you are not satisfied, you can return your purchases made at www.gatell.com in our own online store or in any of the Gatell stores in Spain. In the second case, you must first contact our Customer Service Department at 93 245 68 45, who will send you a return authorization that you will have to present at the store. On the other hand, products purchased in a Gatell store cannot be returned in the online store, so we will only accept returns of items purchased exclusively at www.gatell.com. The maximum period for requesting a return is stipulated in 7 working days from receipt of the order. The circumstances that can cause a return are the following: a) If the product you ordered does not satisfy you: You can return it via courier to gatell.com. We will refund the amount of the product but not the cost of returning the product paid in the order. b) Defective product of origin: Once gatell.com receives the defective product will send you another one. In this case the exchange will always be made for the same article or reference. You will only be billed for the first shipment, and gatell.com will be responsible for the return and new shipment costs. If you wish to make an exchange for another article, the costs of return and new shipment will not be assumed by gatell.com c) Product that, by mistake, does not correspond to the order: gatell.com will bear the costs of collection of the wrong product and delivery of the product corresponding to the order placed. For all cases of withdrawal, regarding shipping costs and return of products shall be as provided in the Royal Legislative Decree 1/2007 and complementary regulations. Neither in the physical stores, nor in the virtual store gatell.com, returns of products that have not been purchased in Spain will be accepted. In all cases, the products must be in perfect condition, in their original packaging.
F. PRODUCT WARRANTY
The warranty period is two years, although it does not include deficiencies caused by negligence, blows, incorrect use or improper handling, incorrect installations not carried out by authorized Technical Services when applicable, etc., or materials that are worn out by use. Unless proven otherwise, it will be presumed that the lack of conformity that becomes apparent within six months after delivery of the product, whether new or second hand, already existed when the thing was delivered, except when this presumption is incompatible with the nature of the product or the nature of the lack of conformity. Gatell.com reserves the right to ask an official technical service of the brand to verify the origin of the problem. In case of a defect caused by misuse, the repair will be billable. In those incidents that justify the use of the warranty, we will opt for the repair, replacement of the article, discount or refund, in the legally established terms.
